KAMU UNO S.A.C. TERMS AND CONDITIONS

KAMU UNO S.A.C. is a Travel Designer. In this capacity, KAMU UNO S.A.C. assists individual travelers in understanding their interests and budgets, helps clients discover unique and off-the-beaten-path experiences, suggests customized itineraries tailored to individual needs, and aids in trip planning. KAMU UNO S.A.C. does not target or assist Tour Operators, Travel Agents, Travel Advisors, or any other resellers or distributors of travel services.

The following terms and conditions outline the contractual agreement between you and KAMU UNO S.A.C.. Please read them carefully, as they define our respective rights and responsibilities. By requesting us to confirm your booking, KAMU assumes that you have had the opportunity to read and have indeed read these terms and conditions and agree to abide by them. These terms and conditions exclusively apply to the travel arrangements you book with KAMU and that KAMU agrees to provide as part of this contract. In these terms and conditions, all references to 'travel,' 'booking,' 'contract,' 'package,' 'tour,' or 'arrangements' pertain to your travel plans unless otherwise stated. In these terms and conditions, 'party leader', 'you' and 'your' refer to all individuals listed on the booking, including anyone added or replaced later, as context dictates. 'KAMU,' 'We,' 'us,' and 'our' refer to KAMU UNO S.A.C.

Standard Conditions on Tours and Travel Programs

• All indicative rates are per guest in US Dollars (USD).

• Services are subject to availability.

• Rates may fluctuate during special events, peak seasons, or holidays.

• Valid passports or Peruvian DNI are mandatory for hotel check-ins.

• Check-in and check-out times comply with hotel policies.

• Activities and itineraries may change due to weather conditions, acts of nature, or other unexpected situations.

Acceptance and Reservation Process

To make a booking, the lead person on the booking (the 'party leader') must declare via email their desire to book services as per the proposal and quotation provided by KAMU. By doing so, the party leader recognizes that has had the opportunity to read, and have indeed read, this document, and agrees to abide by the terms and conditions contained in it. The party leader must have authorization from all individuals listed on the booking, as well as from the parent or guardian for any party members under 18 years of age at the time of booking. The party leader confirms their authorization and responsibility for making all necessary payments. The party leader must be at least 18 years old when making the booking. KAMU will require the following personal information from all travelers:

• Full Names

• Scanned copy of the passport’s information and photo page, or Peruvian DNI

• Date of Birth

• Nationality

• Dietary Instructions

• Special Remarks

• International arrival and departure flight details with PNR Code (if available)

• Internal flight details with PNR Code (if available)

Following this process, you will receive a booking confirmation and instructions for making the initial deposit.

Copy of Passport requirement

In accordance with a government requirement related to international money laundering, the Peruvian State requires travel companies to obtain and keep on file a copy of the passport of foreign travelers to Peru. Accordingly, KAMU needs to receive a copy of each guest's passport information and photo page before reconfirming travel services. These copies and the information contained therein will be handled with absolute confidentiality and will not be used for any other purpose by KAMU.

Booking Status

Upon confirming the availability of your chosen arrangements, we will issue a booking status and send it to you. Please review this receipt carefully upon receipt and contact us immediately if any information appears incorrect or incomplete, as changes may not be possible.

Securing a Booking and Payment Conditions

It is important to reconfirm and pay for bookings within the period indicated by KAMU. The following deadlines are referential and will be validated by KAMU at the time of confirming the reservation, since some of our suppliers work according to their own special policies.

• Once we issue a booking confirmation email to secure a booking, we must receive payment of the minimum deposit, which is 20% of the total trip price. Otherwise, reserved spaces will be subject to availability.

• The remaining 80% is due no later than 45 days before the start of your trip. (It is 60 days in case of groups of 6 or more guests.)

• If booking within 45 days of your trip's start date or at an earlier stage for some trips, full payment is required. (It is 60 days in case of groups of 6 or more guests.)

• Full payment for tickets to Machu Picchu, Huayna Picchu, Machu Picchu Mountain, Huchuy Picchu and the Inca Trail, and flights, will usually be required at the time of booking, in order to ensure availability.

If an extension is required, you must inform KAMU in advance, so that the corresponding consultations can be made.

All clients (including any added or replaced later) are considered to have accepted our conditions.

Travel Information & Documents

Before your travel departure, you will receive a document containing crucial information related to your travel package. We strongly recommend that you carefully review this document and its contents, including tickets, itineraries, and passenger names.

Change of Booking

If you wish to change any part of your travel arrangements after receiving the invoice, we will do our best to accommodate the change, although it may not always be possible. If the change is possible, it will be subject to an administration charge and payment of any additional costs incurred due to the change.

Penalties for modifications & cancellations

Modifications and cancellations will not be subject to an additional charge if they are made within the reconfirmation deadline, done before the payment of your deposit.

Name changes or corrections may be subject to penalties. KAMU will inform you if this is the case.

Cancellations outside the established deadlines will be subject to a 100% penalty.

In the event of exceptional health grounds, the request will be processed with each supplier, including presentation of the traveler's medical certificate, with each supplier retaining the right to accept or deny the request.

Travel Insurance

We strongly recommend comprehensive travel insurance that covers cancellation charges (reimbursing the cost of airline tickets and non-refundable payments), lost and delayed luggage, and other travel-related risks. We advise leaving jewelry and other valuables at home, as most travel insurance policies do not cover theft-related losses. Additionally, we highly recommend international medical insurance coverage.

KAMU's Limit of Liability

KAMU operates as a Travel Designer and coordinates independent suppliers, operators, and/or Destination Management Companies (DMCs) that are beyond its control. KAMU cannot be held responsible for death, personal injury, or any losses arising from an act or omission of any of these suppliers or other events outside its control.

We commit to ensuring that the trip arrangements we have agreed to provide under our contract with you are executed with reasonable skill and care. This means that, subject to these terms and conditions and other information forming part of your contract with us, we accept responsibility if your contracted trip arrangements are not delivered as promised or prove to be deficient due to the failure of ourselves, our employees, agents, or suppliers to use reasonable skill and care in delivering your contracted trip arrangements. Please note that if you wish to make a claim against us, you must demonstrate that reasonable skill and care were not applied.

Disruption to Tour & Itinerary Arrangements and Events beyond KAMU's Control

Itineraries are intended as guidelines and may be subject to alteration without prior notice due to reasons such as road or river conditions, weather, strikes, or other factors beyond our control. If conditions render certain routes unsafe, KAMU reserves the right to provide alternative services, including accommodation or alternative land arrangements. Under normal conditions, itineraries will be executed as closely as possible to the plan. However, there may be times when changes to your itinerary are necessary due to events beyond our control. KAMU will not be responsible for direct or indirect costs incurred as a result of events or factors beyond our control that necessitate itinerary changes. KAMU is not responsible for unforeseeable events, including, but not limited to, fires, acts of local governments or their authorities, wars, civil disturbances, riots, terrorist acts, attacks, thefts, epidemics, quarantines, adverse weather conditions, imputed damage to air, sea, and land, air transport, or any act or incident beyond its control or that of its suppliers. In addition, you are not entitled to any refunds for itinerary changes caused by such unforeseeable events. KAMU cannot guarantee exact arrival and departure times for carriers and operators used by KAMU, and KAMU will not be liable for missed connections with other services or attractions beyond our control.

KAMU will not be liable for any injury, illness, death, loss (including loss of possessions and loss of enjoyment), damage, expense, cost, or any other claim resulting from any of the following:

• Actions or omissions by you or any member of your party.

• Actions or omissions by a third party unrelated to the provision of your trip, which were unforeseeable and extraordinary events beyond our control.

Please be aware that KAMU cannot accept responsibility for services that are not part of our contract. This includes additional services or facilities provided by a supplier, which were not advertised by us and not agreed upon as part of our contract. Optional excursions or activities booked during your travel do not form part of our contract, as these are directly arranged by the respective suppliers.

If, according to any representative of KAMU, your mental or physical condition is such that it affects your health and safety, renders you unable to care for yourself, makes you a hazard to yourself or other travelers, or results in you becoming objectionable to other travelers or staff, you will not be allowed to continue on the whole or any part of the itinerary. KAMU is not liable for any costs associated with such a decision, and you will not receive a refund for any part of the itinerary.

Our commitments regarding the services we have agreed to provide or arrange as part of our contract, as well as the laws and regulations of Peru, will determine whether the services were properly delivered. Keep in mind that standards of safety, hygiene, and quality may vary across destinations, services, and transportation involved in your trip and may be different from those applicable in your home country.

Adventure and Soft Adventure Activities

If you choose to include soft-adventure or adventure activities in your itinerary, you recognize that such activities involve, by nature, a certain degree of risk, and you accept and assume the risks, implications, and consequences derived from their practice. You accept that KAMU will not be responsible for any consequences associated with the practice of soft-adventure and adventure activities. These acceptances also include family members or groups of travelers participating in any soft adventure or adventure activity as part of your party. Soft-adventure and adventure activities include, but are not limited to the following: Mountain biking, Cycling, Motorbiking, Horseback riding, Ziplining, Mountain climbing, Trekking, Kayaking, Rafting, Stand-up paddling, Kite surfing, Windsurfing, Surfing, Sandboarding, Paragliding, Sand-buggy riding.

Responsibility of KAMU with flights

Domestic and international flights are subject to overbooking, cancellations, or rescheduling. In such cases, KAMU will make every effort to assist customers in boarding their respective flights or making alternative arrangements. These actions are provided as a courtesy by KAMU to its customers. KAMU will not be responsible for boarding denials, additional charges due to fare differences, or expenses related to lodging, meals, and additional transfers provided by the airline in cases of flight cancellations or delays.

Special Requests and Medical Conditions/Disabilities

If you have special requests, such as dietary restrictions, room preferences, or specific facilities at a hotel, please inform us at the time of booking. The provision of a special request does not form part of our contract unless explicitly confirmed.

If you or any member of your party has a medical condition or disability that may impact your travel or has specific requirements due to such a condition or disability (including those affecting the booking process), please inform us before confirming your booking. This allows us to assist you in assessing the suitability of the arrangements in your initial booking. If a medical condition or disability arises after your booking is confirmed, please promptly inform us. If we cannot adequately accommodate the needs of the person in question or if full details of the condition/disability are not disclosed at the time of booking, we reserve the right to decline or cancel the reservation.

Passports, Visas & Health Matters

All travelers must possess a passport valid for at least six months beyond the departure date. Travelers are responsible for complying with passport requirements and associated costs. General passport and visa requirements applicable at the time of booking will be communicated to travelers and/or the party leader. However, requirements may change, and you must verify passport and visa requirements with the embassy or consulate of the country(ies) to which you intend to travel. The party leader is responsible for ensuring that all members of the party possess all necessary travel and health documents before departure. All costs related to obtaining such documentation must be borne by the traveler and/or party leader. We regret that we cannot accept liability if you are denied entry onto any transportation, place of interest, or country due to your failure to carry required documentation. If your failure to have necessary travel or other documents results in fines, surcharges, financial penalties, or costs imposed on or incurred by us, you are responsible for reimbursing us accordingly. KAMU is not responsible for conveying or enforcing visa, customs, vaccination procedures/requirements, or Travel Warnings issued by the countries of origin or destination.

Not Included

All inclusions are listed and detailed in KAMU’s quotations, proposals, and/or travel vouchers. Anything not listed as included in the itinerary is therefore not included. Guests are responsible for their passports, visas, travel insurance, payment of excess baggage, travel permits, airline requirements, as well as any pre-departure forms required by authorities, transportation companies, governments, etc. In addition, personal requests such as additional beverages, laundry service, communication expenses (calls, faxes, e-mails, roaming service, etc.), tips, or other services and fees not specified in the itinerary

General Sales Tax Exemption for Hotels – Peru (I.G.V.)

According to Peruvian law, providing lodging and food services to non-resident individuals, either individually or through a tourist package, is exempt from the General Sales Tax (18%) upon presentation of a passport and the guest's physical or virtual Andean migration card during hotel check-in. To enjoy this exemption, the services used in the hotel must be coordinated, assembled, conducted, and organized by Travel and Tourism Agencies based in Peru. Transfers of payments from foreign travel agencies are not covered by this exemption and will be subject to 18% IGV.

Privacy Policy and Data Protection

KAMU safeguards customer information and does not share it with third parties unless authorized by customers for purposes related to the planning of their tourism programs. KAMU considers personal data, details of tourist programs, and payment-related information as confidential. Our Privacy Policy provides detailed information on why we collect this data and who may receive it.

Communication

KAMU aims to establish communication with customers through various personal, physical, and electronic channels. However, we respect international boundaries and regulations. If any communication from KAMU is perceived as uncomfortable, offensive, or annoying, please contact hola@kamu.uno for prompt resolution.

Credits and Copyrights

The texts, images, and videos required for KAMU’s website have been developed and are the property of KAMU, except for those provided by authorized suppliers, institutions, independent photographers, and friends.

Governing Law and Jurisdiction

These Terms are governed by and will be interpreted in accordance with the laws of Peru. Any disputes arising from, under, or in connection with these Terms will be subject to the exclusive jurisdiction of the Courts of Lima, Peru.
